To all whom it may concern: Be it known that the PRISMATIC ELECTRO GLAZING COMPANY, a corporation organized under and by virtue of the laws of the State of Illinois, and doing business in the city of Chicago, in said State, has adopted for its use a Trade-Mark for Prismatic Glass, of which the following is a specification. The trade-mark of the said company consists of the word-symbol "Luxfer." This trade-mark is illustrated in the accompanying facsimile, where it is set out in plain capital letters; but the style of the lettering is unimportant and may be varied at will, and the word may be used either alone or in connection with other words without materially affecting the character of said trade-mark, the essential feature of which is the word-symbol "LUXFER." In the accompanying facsimile the word "Luxfer" is shown as used in connection with the word "Prisms," but it is of course evident that any other desired word may be used in this connection upon the goods themselves. |
This trade-mark has been continuously used by
said corporation since about the 11th day of January, 1897. The class of merchandise to which this trade-mark is appropriated is prismatic glass, and the particular description of the goods comprised in such class on which it is used by the said company is prismatic window-lights and vault-lights or prismatic window-plates and pavement-lights, or, in other words, glass bodies having prisms formed thereon and projecting therefrom for the purpose of distributing light. It is usually affixed to the goods by printing or stamping or otherwise forming it on the boxes in which the articles are packed or the frame in which they are placed. By WILLIAM A. ILLSLEY, Prest. State of Illinois county of Cook, ss. WILLIAM A. ILLSLEY, being duly sworn, deposes and says that he is the president of the corporation, PRISMATIC ELECTRO GLAZING COMPANY, the applicant named in the above-entitled case; that he verily believes that the statement filed therein is true; that it has at this time a right to use of the trade-mark therein described; that no other person, firm or corporation has the right to such use, either in the identical form or in such near resemblance thereto as might be calculated to deceive; |
that it is used by said company in commerce between the United States and
foreign nations, and particularly with Canada; and that the description
and facsimile presented for record truly represent the trade-mark sought
to be registered.
